Upload Terms

These Upload Terms apply when you upload photos, videos, or other files ("Content") through a QR code powered by The QR Vault, operated by Malaga Web Designs based in Spain. By tapping "I Agree — Continue" on the upload page, you accept these terms in full.
1. Your Consent
By uploading Content, you confirm that you have read and agree to these Upload Terms. Your IP address, the date and time of your upload, and your device information are logged for legal and security purposes.
2. Content Ownership & Rights
By uploading Content, you confirm that:
- You are the owner of the Content, or you have obtained permission from the owner to upload it
- The Content does not infringe any third party's copyright, trademark, privacy, or other rights
- You have the consent of any individuals appearing in the Content (or their parent/guardian if under 16)
3. Licence to the QR Code Owner
By uploading Content, you grant the QR code owner (the person or business who created the QR code) a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and share your uploaded Content for their personal or business purposes, including but not limited to social media, websites, marketing materials, and internal use.
This licence does not transfer ownership of your Content. You retain all rights you hold in the original Content.
4. Prohibited Content
You must NOT upload any Content that:
- Is illegal, obscene, pornographic, or sexually explicit
- Contains child sexual abuse material (CSAM) — this will be reported to law enforcement immediately
- Is threatening, abusive, harassing, defamatory, or hateful
- Promotes violence, terrorism, or self-harm
- Infringes the intellectual property rights of others
- Contains malware, viruses, or any malicious code
- Violates any applicable law or regulation
- Contains personal data of others without their consent
We reserve the right to remove any Content that violates these terms without notice. Serious violations will be reported to the relevant authorities.
5. Content Monitoring & Removal
The QR code owner is responsible for monitoring Content uploaded through their QR code. The QR Vault is not obligated to review all uploaded Content but reserves the right to do so.
If you believe Content has been uploaded that infringes your rights, please contact us at hello@theqrvault.com with details, and we will investigate promptly.
6. DMCA / Takedown Requests
If you are a copyright owner (or authorised to act on behalf of one) and believe Content uploaded through The QR Vault infringes your copyright, please send a takedown notice to hello@theqrvault.com including:
- A description of the copyrighted work you claim has been infringed
- The URL or location of the infringing Content
- Your contact information (name, email, phone number)
- A statement that you believe in good faith the use is not authorised
- A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorised to act on their behalf
We will respond to valid takedown requests within 48 hours and remove infringing Content promptly.
7. Data Collection
When you upload Content, we collect and store:
- The uploaded files
- Your IP address
- Your device type and browser information (user agent)
- The date and time of the upload
- Your consent acknowledgement

8. Liability
You upload Content at your own risk. The QR Vault and Malaga Web Designs accept no liability for any Content uploaded by users. If you upload Content that violates these terms, you may be held personally liable for any resulting legal claims, damages, or penalties.
9. Indemnification
You agree to indemnify and hold harmless The QR Vault and Malaga Web Designs from any claims, damages, costs, or expenses arising from Content you upload, including any claims of copyright infringement, privacy violation, or other rights infringement.
10. Changes to These Terms
We may update these Upload Terms from time to time. The current version will always be available on this page. Continued use of the upload feature constitutes acceptance of any changes.
