1. Agreement to Terms

By accessing or using The QR Vault ("Service"), operated by Malaga Web Designs based in Spain, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

2. Description of Service

The QR Vault provides a platform for creating QR codes that allow guests to upload photos and videos. QR codes remain active for as long as your subscription is active. The service includes cloud storage, custom branding, admin-only viewing of uploaded content, guest-to-owner messaging, and multi-language support for the guest upload page (English, Spanish, French, German, Portuguese, and Simplified Chinese).

3. Account Registration

To use our Service, you must:

  • Be at least 16 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer four subscription tiers, each available monthly or yearly (yearly billing includes 2 months free):

  • Starter: £9/month or £90/year - 25GB storage, 50MB max file size
  • Pro: £15/month or £150/year - 100GB storage, 200MB max file size
  • Premium: £29/month or £290/year - 500GB storage, 500MB max file size
  • Business: £149/month or £1,490/year - 2TB storage, 500MB max file size, up to 10 QR codes

All plans include one QR code (active while subscribed), custom branding, and admin-only viewing. Business includes multiple QR codes. Uploads are subject to your plan's storage limit.

4.2 Payment Terms

  • Subscriptions are billed monthly in advance
  • Payments are processed securely through Stripe
  • All fees are non-refundable except as required by law or our 30-day money-back guarantee
  • Prices are subject to change with 30 days' notice
  • Failed payments may result in service suspension

4.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings
  • Cancellations take effect at the end of the current billing period
  • We offer a 30-day money-back guarantee for new subscriptions
  • Upon cancellation, your data will be retained for 30 days before permanent deletion
  • You may request immediate data deletion by contacting us

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Upload illegal, harmful, or offensive content
  • Violate any intellectual property rights
  • Upload malware, viruses, or malicious code
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any unlawful purpose
  • Share adult content involving minors
  • Send abusive, threatening, or spam messages to account owners
  • Violate any applicable laws or regulations

5.1 Guest Messaging

Account owners may enable a messaging feature that allows guests to send short text messages from the upload page. Messages must not contain abusive, threatening, harassing, or illegal content. We reserve the right to disable messaging for any user and to remove messages that violate these Terms. The sender's IP address is logged with each message for security and abuse prevention purposes.

6. Content Ownership and License

6.1 Your Content

You retain all ownership rights to content you upload. By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

6.2 Guest Uploads

Content uploaded by your guests through your QR code becomes part of your account. Before uploading, all guests must agree to our Upload Terms, which require them to confirm they own the content, that it does not contain prohibited material, and that they grant you a licence to use it. You are responsible for monitoring content uploaded via your QR code and ensuring it complies with these Terms.

6.3 Content Monitoring & Takedowns

We reserve the right to review, monitor, and remove content that violates these Terms without notice. However, we are not obligated to monitor all content and are not responsible for user-uploaded content. If you become aware of prohibited content in your gallery, you must delete it immediately or report it to us at hello@theqrvault.com.

6.4 Prohibited Content

The following content is strictly prohibited on The QR Vault and will result in immediate account termination:

  • Child sexual abuse material (CSAM) — will be reported to law enforcement
  • Pornographic or sexually explicit material
  • Content promoting violence, terrorism, or self-harm
  • Content that is threatening, abusive, harassing, defamatory, or hateful
  • Content that infringes the intellectual property rights of others
  • Content containing personal data of others without their consent
  • Malware, viruses, or malicious code

6.5 Showcase Submissions

Account holders may voluntarily submit photos from their gallery to The QR Vault Showcase — a public page featuring real venues using our platform. By submitting content to the Showcase, you:

  • Confirm you have the right to share the submitted content
  • Grant The QR Vault a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and share the content on our website, social media accounts, and marketing materials
  • Understand that your venue or event name will be displayed as a credit alongside the content
  • Acknowledge that all submissions are reviewed before publication and may be rejected at our discretion
  • May request removal of your showcase submissions at any time by contacting hello@theqrvault.com

Explicit consent is collected at the point of each submission. This licence survives account cancellation unless you request removal. We will make reasonable efforts to remove content promptly upon request.

7. Storage Limits and Fair Use

  • Storage limits are based on your subscription tier
  • If you exceed your storage limit, you must upgrade or delete content
  • We may suspend uploads if you consistently exceed your limit
  • File size limits apply per upload as specified in your plan
  • We reserve the right to enforce fair use policies to prevent abuse

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may suspend or terminate the Service for maintenance, updates, or unforeseen circumstances. We are not liable for any downtime or data loss.

9. Data Backup and Security

While we implement security measures to protect your data, you are responsible for maintaining your own backups of important content. We are not liable for data loss due to technical failures, security breaches, or user error.

10. Intellectual Property

The QR Vault name, logo, design, and all related intellectual property are owned by Malaga Web Designs. You may not use our trademarks or branding without written permission.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid in the last 12 months
  • We are not responsible for third-party content or services
  • We are not liable for loss of data, profits, or business opportunities

12. Indemnification

You agree to indemnify and hold harmless Malaga Web Designs from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your account immediately if you:

  • Violate these Terms and Conditions
  • Fail to pay subscription fees
  • Engage in fraudulent or illegal activity
  • Abuse or misuse the Service

Upon termination, your access to the Service will cease, and your data may be deleted after 30 days.

14. Dispute Resolution

Any disputes arising from these Terms shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Spain.

15. Governing Law

These Terms are governed by the laws of Spain, without regard to conflict of law principles.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Malaga Web Designs regarding the use of the Service.
